1. Account Creation and Acceptance of Terms

1. Creating an Account: By creating an account and accepting these terms, you become a member of our community. Your use of our services during this period means you agree to abide by the rules specified in these terms, so please read and understand them carefully.
2. Acceptance of Terms: If you do not agree to these terms, you must leave the Allwintheme website. Access to and use of this website, whether you are a member or not, is conditional on your acceptance of these terms and the privacy policy.

2. Subscription and User Eligibility

1. Subscription Rights: Upon becoming a subscriber or member, you can access our resource directory, and these resources must be used in accordance with the GPL license. Only real users can subscribe to Allwintheme using real information.
2. Age Requirement: You must be at least 18 years old to become a subscriber or member. If you are under 18, you must use the account of a parent or legal guardian who is at least 18 years old and has given their permission, and that adult will be responsible for all your activities.

3. User Responsibilities

1. You warrant that the information you provide to us is true, accurate, and complete, and you will keep your account information (including your current email address) up to date.
2. Your subscription is non-transferable.
3. You are responsible for all activities conducted using your username and password to access Allwintheme. You must keep your password secure and must not allow others to use your username or password.

4. Refund Policy

1. Due to the nature of digital content being immediately downloadable upon purchase, there is no “trial period” or “grace period” after purchasing a subscription or product, meaning all sales are final. Once content is downloaded, it cannot be “returned”. Therefore, we do not offer refunds unless we make significant adverse changes to these terms.
2. Special Note: The products you purchase are GPL-licensed. If you have not purchased a license from the developer, some features in the themes and plugins may not be available, and in such cases, we will not provide a refund. If you want to ensure the product works properly (as it has been tested), please purchase the product at the original price from the developer.
3. Situations Where Refunds Are Not Supported: We will evaluate refund requests on a case-by-case basis, but generally, we are not required to provide a refund in the following circumstances:
   • You change your mind
   • You subscribed by mistake
   • You request a refund as a “courtesy”
   • You lack the technical ability to operate the item
   • You cannot download the item because it has been removed from the website
   • You violate our fair competition policy
   • A feature you wish to use is unavailable due to the need for a license

5. Product Support

1. GPL WordPress plugins and themes are provided “as is” and there is no guarantee that they will function exactly as you expect or be compatible with all third-party components and add-ons.
2. We cannot provide technical support for downloaded content. Support for third-party products is provided by their authors, not Allwintheme. Please check the support terms provided by the product authors before making a purchase.
3. Our support is limited to billing and/or technical inquiries related to the Allwintheme.com website.

6. Fair Competition and Code of Conduct

1. Your use of Allwintheme (including content and features) must comply with the policies we establish from time to time, including the fair use policy. Being a subscriber/member is a privilege reserved for users who abide by reasonable rules.
2. We may, at our sole discretion, determine whether your use complies with these terms and may suspend or terminate your subscription account at any time for reasonable reasons, including but not limited to:
   • Violation of these terms
   • Behavior inconsistent with community values
   • Behavior that may cause harm to us or others
3. Customers with permanently terminated accounts are not allowed to apply for new accounts and will not receive a refund. Specific reasons for account termination include:
   • Abusive behavior and/or excessively negative attitudes towards employees and/or other customers
   • Repeated defamation, malicious and/or false statements (including defaming us, attempting to persuade potential customers not to purchase our products)
   • Promoting competitors’ products, facilitating software piracy, hacking, spamming, or illegal activities
   • Attempting to circumvent the fair use policy

7. Fair Use Policy

We implement a fair use download policy. Allwintheme is for real users (using real information). Other GPL websites are prohibited from using it to expand their inventory, and sharing, reselling, or hoarding our products is also not allowed. Such behavior will result in immediate account termination without a refund.

8. Third-Party Services

1. In our semi-annual, annual, and lifetime plans, we provide access to certain third-party services (such as Envato Elements); in annual and lifetime plans, we also provide access to Freepik.
2. These are external services, and we only provide a way to access them, not our own accounts, nor can we guarantee their 100% stability (as we have no control over Envato Elements or Freepik). Our services primarily focus on GPL products, for which we provide guarantees.
3. Access to Envato Elements and Freepik is provided only as a bonus and is not part of the plan. If they take action to prevent us from continuing to provide their services, we will no longer be able to offer them in existing plans but will not actively remove them.

9. Explanation of Lifetime Membership

Lifetime membership is not a regularly available option. The term “lifetime” does not mean you will enjoy the service forever or for your entire life. It means you will not need to pay again and can continue to use the service while the project is active, i.e., you will enjoy membership benefits during the project period without additional fees.

10. Changes to Membership and Prices

1. We do not guarantee that specific products will continue to be available on the website. We reserve the right to modify or discontinue all or part of the downloadable content at any time without prior notice; we may also add new downloadable content without prior notice.
2. The price of any product may change at any time, and the changes will be posted on the website.

11. Links

We have not reviewed all websites linked to this website and are not responsible for the content of any such linked websites. Inclusion of a link does not imply our endorsement of its content.

12. Trademark, Copyright, and Intellectual Property Notice

We respect the intellectual property rights of others. If you believe that an item or content on Allwintheme infringes any intellectual property right, please refer to our copyright policy.

13. Liability and Indemnification

1. You shall indemnify us against all losses, costs (including fully compensated legal fees), expenses, claims, or liabilities arising from any third-party claims against us due to your use of Allwintheme or any of its features or services.
2. Allwintheme and the elements on its website are provided “as is” without any express or implied warranties, including implied warranties of non-infringement, merchantability, and fitness for a particular purpose.
3. Our liability to you arising from Allwintheme or these terms, whether contractual, tortious (including negligence), or otherwise, is limited as follows:
   • We shall not be liable for loss of income, loss of profits, loss of goodwill, loss of customers, loss of capital, damage to reputation, loss related to any other contract, data loss, or any indirect, consequential, or special loss, damage, or expense;
   • Our total liability to you shall be limited to the total amount you paid to us in the 6 months prior to the date of the claim giving rise to the liability.

14. Service Availability

We strive to provide 24/7 access to Allwintheme, but the internet is unpredictable. You may be unable to access Allwintheme at any time for any reason (whether with prior notice or not), and we may also change the way Allwintheme operates (including the types of goods available on the website). We shall not be liable for any loss you suffer due to such circumstances.

15. Third-Party Representation

If you accept these terms on behalf of another person, you warrant that you have full legal authority to bind that person. Please note that only real users can join the GPL club.

16. Consumer Law

1. Certain regions may have non-exclusive guarantees, warranties, or other rights (“non-exclusive consumer guarantees”). We shall not exclude, limit, or modify non-exclusive consumer guarantees in these terms.
2. Except for exclusive consumer guarantees, we shall only be bound by the express commitments in these terms. For breaches of non-exclusive consumer guarantees, our liability shall be limited (at our sole discretion) to replacing the relevant goods or services or paying for their replacement (unless otherwise specified by the non-exclusive consumer guarantees).
3. You shall not use the goods in a way that violates any export laws applicable to you.

17. Account Restrictions and Payment Processing

1. If we reasonably believe that you, your subscription, or your payment poses a risk (including violation of laws or regulations), we may block you, cancel your subscription, or refuse to process payments.
2. Such measures may be taken in cases including: transactions where payments are from or directed to individuals or countries subject to sanctions by authorities (such as the United Nations or European member states); or where we reasonably believe there is a legal, regulatory risk, or a risk of loss to us or our members.
3. You warrant that you are not in a sanctioned country/region or on a sanctions list. If we cannot process payments to or from a country, we may block members from that country.
4. We may take any of the measures described in this section without prior notice. As the website is global, different laws may apply to restrict our relationship with you.

18. Relationship Between the Parties

Nothing in these terms shall constitute a partnership, joint venture, employment, or agency relationship between you and us, or between you and any other member. Neither you nor we shall be bound by the other in any way.

2. If the modifications have a significant impact or cause damage to you, you may cancel your subscription in accordance with Section 7 above after proving such damage to us. However, if you continue to use GPL Stock after the modifications, regardless of the time elapsed, you are deemed to have accepted the modifications.
3. Whether a modification constitutes a significant impact depends on the nature of the modification and your specific circumstances. For example, modifications that result in higher transaction fees or the removal of an entire category of goods may have a significant impact on the value you obtain from the website; while the removal of individual elements or minor clarifications to the terms will generally not have a significant impact.

21. Interpretation of Terms

Words such as “including” and “including but not limited to” are not restrictive; “at our sole discretion” means determined by our independent judgment.
